1. Acceptance of Terms

By accessing and using ionclash.tech's lead generation services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

ionclash.tech provides AI-powered lead generation and social network advertising services. Our platform helps businesses identify, target, and engage potential customers through various digital marketing channels including social media platforms and search engines.

3. Service Pricing and Payment

Our services are priced on a per-qualified-lead basis:

  • Social Media Campaigns: $40 per qualified lead
  • Search Engine Marketing: $50 per qualified lead
  • Premium Targeting: $60 per qualified lead

Payment is due upon delivery of qualified leads. We reserve the right to modify pricing with 30 days written notice.

4. Lead Quality Standards

We define a "qualified lead" as a prospect who:

  • Meets your specified demographic and behavioral criteria
  • Has shown genuine interest in your products or services
  • Provides accurate contact information
  • Has not opted out of marketing communications

5. Client Responsibilities

Clients are responsible for:

  • Providing accurate target audience specifications
  • Complying with all applicable laws and regulations
  • Maintaining appropriate licenses for their business activities
  • Following up with leads in a timely and professional manner

6. Data Privacy and Protection

We are committed to protecting the privacy of all data collected through our services. All lead data is collected in compliance with applicable privacy laws including GDPR, CCPA, and other relevant regulations. We do not sell or share personal data with third parties except as necessary to provide our services.

7. Intellectual Property

The ionclash.tech platform, including all software, algorithms, and proprietary technology, remains the exclusive property of ionclash.tech. Clients receive a limited license to use our services but do not acquire any ownership rights.

8. Limitation of Liability

ionclash.tech's liability is limited to the amount paid for services in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages arising from the use of our services.

9. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service availability. Scheduled maintenance will be communicated in advance when possible.

10. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination, all outstanding payments become due immediately, and access to our platform will be discontinued.

11. Compliance and Legal Requirements

Clients must ensure their use of our services complies with:

  • CAN-SPAM Act and similar anti-spam legislation
  • Telephone Consumer Protection Act (TCPA)
  • General Data Protection Regulation (GDPR)
  • California Consumer Privacy Act (CCPA)
  • All applicable industry-specific regulations

12. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective 30 days after posting on our website. Continued use of our services constitutes acceptance of modified terms.

13. Governing Law

These terms are governed by the laws of New Mexico, United States. Any disputes will be resolved in the courts of Carlsbad, New Mexico.
